% 26.07.2018 1.
The petitioner has filed the present petitions impugning an order dated 04.04.2012, whereby the registration of the trademark granted to the petitioner was cancelled. The said order was passed, inter alia, pursuant to
the rectification application filed by respondent no.4/Times Publishing House Limited.
2.
The learned counsel for the parties state that the petitioner and respondent no.4 have settled all the disputes and entered into a global settlement. It is contended that in terms of the settlement, respondent no.4 has no objection to the petitioner retaining the marks that were registered in its favour and in this view the impugned order may be set aside. 3.
In view of the above and with the consent of the parties, the petitions are allowed and the impugned order dated 04.04.2012 is set aside to the extent that the impugned order cancels the registration of the Trademark 'Financial Times' bearing registration nos.468936 and 468937 in Classes 9 and 16, respectively.
4.
The petition is disposed of in the above terms. VIBHU BAKHRU, J JULY 26, 2018 MK
