By way of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks regular bail in connection with FIR No. 839/2021, dated 21.11.2021, registered at Police Station Okhla Industrial Area for an offence punishable under Section 302 of the Indian Penal Code, 1860.

At the outset, Mr. Neeraj Kumar, learned Standing Counsel for the Delhi High Court Legal Services Committee, appearing on behalf of the applicant, submits that although all material witnesses have been examined, the applicant had filed an application before the learned Sessions Court seeking recall of a material witness, namely PW-8. applicant has preferred a petition before this Court, vide Diary No. 103798/2026. In view of the fact that the outcome of the said petition may have a bearing upon the adjudication of the present application, Mr. Kumar states that the applicant does not wish to press the present application at this stage, while reserving the applicant's rights and contentions.

The application is accordingly dismissed as withdrawn, in terms of the above submission.
