This is a petition filed by the petitioner under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') seeking permission to travel abroad (Dubai) between 27.11.2024 to 02.12.2024 for the purpose of business development and meetings with various fertilizer trading companies.

Notice was issued on the last date of hearing. 3.

The respondent has filed a reply. However the same is not on record. Mr Sabharwal, learned counsel for the respondent has handed over the copy of reply which is taken on record.

Learned counsel for the respondent states that the brother of the petitioner is in London and is absconding. In case the petitioner is permitted to travel abroad, the trial pending before the learned Special Judge shall be hampered.

My attention is drawn to an order dated 09.08.2024 and 13.09.2024 passed by this Court wherein the petitioner has been given permission to travel abroad in the past and on every such permission the petitioner has complied with the conditions.

It is stated that the petitioner is not travelling to London this time. 7.

For the said reasons, the petition is allowed and the petitioner is permitted to travel abroad i.e. Dubai subject to the following terms and conditions:

(i) The petitioner shall furnish the detailed addresses of the persons from whom he has an invite and whom he intends to meet. (ii) The petitioner shall furnish the details of air-ticket, stay, where he intends to reside in Dubai and his contact number along with itinerary with the concerned Investigating Officer. (iii) The petitioner shall furnish a surety in the amount of Rs. 5,00,000/- by way of FDR before the concerned Trial Court. (iv) The petitioner shall not alienate any movable or immovable assets belonging to him or to persons related to him, during his period of travel.

(v) The petitioner undertakes that he would strictly abide by the time frame and would return on or before 02.12.2024. 8.

The petition is disposed of accordingly.

A copy of this order be communicated to the concerned Trial Court for information and compliance.
