By this petition, the petitioner seeks regular bail in case FIR No.88/2018 under Sections 307/34 IPC registered at PS Jafrabad on the complaint of one Imran, the injured. Imran in his complaint stated that on 9th February, 2018 while he was walking in the gali in front of his house at around 8:00 PM, Shamshad, the petitioner herein, whom he already knew and was residing in his vicinity came along with his two associates. He had seen the two associates of Shamshad earlier also with him and can identify them if produced before him. Shamshad demanded ₹100/- from Imran to which he refused saying that he did not have the same. On this, the two friends of Shamshad slapped him. When Imran tried to take out his phone from his pocket to call his friend, then one of the two friends of Shamshad attacked him on the right side of his chest by knife which caused injury on BAIL APPLN. 549/2018
his chest. Thereafter Shamshad and his friends ran away from the spot. 2.
Learned Additional Public Prosecutor for the State submits that one out of the two associates of Shamshad who inflicted the injury is a juvenile and the other associate has not been arrested till date. 3.
Nature of injury opined by the doctor to the complainant is simple in nature. Petitioner has been in custody since 11th February, 2018. Considering the fact that the petitioner is in custody and the charge sheet is likely to be filed shortly and the investigation qua petitioner is complete, this Court deems it fit to grant bail to the petitioner. It is, therefore, directed that the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount subject to the satisfaction of the learned Trial Court further subject to the condition that in case of change of address, he will intimate the same to the Court concerned. 4.
Petition is disposed of.
