Petition under Section 482 of the Code of Criminal Procedure, 1973/Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') has been filed on behalf of the Petitioners for quashing of FIR No. 195/2021 under Sections 354/353A/354-B/506/341/509/323/356/379/34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC'), registered at Police Station Nand Nagari and all the consequent proceedings emanating therefrom., in terms of the Settlement dated 07.04.2022.

It is further submitted that on 10.03.2021, on the complaint of the respondent No. 2, an FIR bearing No. 195/2021 under Sections 354/353A/354-B/506/341/509/323/356/379/34 of IPC, got registered at Police Station Nand Nagari.

The Complainant/Prosecutrix is present in person, who submits that the disputes mentioned in the said FIR, had arisen during the subsistence of a marriage with the Petitioner No. 1, namely, Mr. Rahul Verma, however, since then, the matter has been settled. The parties have taken divorce and they have got re-married.

It is stated that the Petitioner No.1 and the respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement Deed dated 07.04.2022 and it is settled between the parties that they shall not make any claim against each other in future and will not file any case/complaint against each other.

In view of the Settlement Deed dated 07.04.2022, the present Petition has been filed.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. The parties have endorsed the amicable settlement and accepted the terms thereof voluntarily.

The parties have submitted that all the disputes have been amicably settled vide Settlement Deed dated 07.04.2022 and thus, no fruitful purpose will be served in continuing with the FIR.

The present petition has been signed by the Petitioners and is supported by their affidavits. The parties have reaffirmed the terms of the settlement arrived at vide Settlement Deed dated 07.04.2022 and they also The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
submit that the said Settlement Deed has been arrived at between the parties, without any pressure and coercion.

Today, the respondent No. 2/wife, who is present in Court, states that she has no objection if the said FIR is quashed. 12.
In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also the fact that the present matter is a family matter, no useful purpose will be served in continuing with the proceedings.

Accordingly, FIR No. 195/2021 under Sections 354/353-A/354B/506/341/509/323/356/379/34 of IPC, registered at Police Station Nand Nagari and all consequential proceedings emanating therefrom are quashed. 14.
The Petition stands disposed of.
