Application under Order XXIII Rule 3 read with Section 151 CPC has been filed on behalf of the both the parties for disposal of the accompanying Appeal, in terms of the compromise between the parties. 2.
It is submitted that both the parties have amicably settled the dispute and Rs.8,00,000/- have been paid to the Appellant and who in turn has handed over peaceful and vacant possession of the Suit Property to the Respondents.

Both the parties submit that the accompanying Appeal be disposed of in terms of the Settlement.

The daughter of the Appellant has joined through VC and the Respondent No. 1, namely, Smt. Vimla Ojha and the Respondent No. 2, namely, Mr. Madhav Ojha, are also present in person.
