% 09.03.2018 Vide the present petition, the petitioner has prayed for a direction to respondent no.2, to delete his name from the list of debarred candidates issued vide notification dated 20th/23rd August, 2016. At this stage, learned senior counsel for the petitioner submits that the petitioner is innocent and the matter is being investigated by the Police Authorities at Ranchi. He submits that the petitioner is duly co-operating in the investigation and, therefore, does not wish to press the petition at this stage. He, however, submits that in case the petitioner is given a clean chit by police authorities at Ranchi, the respondent no.2 may be directed to reconsider the matter in accordance with law. Learned counsel for the respondent no.2 has no objection to the aforesaid course of action.
Leaned senior counsel for the petitioner submits that he has instructions to state that there is delay in the investigation because of the non-cooperation of the respondents/authorities. Learned counsel for respondent no.2 assures the Court that as and when any assistance is required from the respondent no.2 by the Police Authorities at Ranchi, the respondent no.2 will co-operate. Accordingly, the writ petition is disposed of as not pressed with a direction to respondent no.2 that in case the petitioner is granted a clean chit and is found innocent by the Police Authorities at Ranchi, the respondent no.2 would re-consider the matter as per law. Needless to say, in case the petitioner is still aggrieved by any order passed by the respondent no.2, they will be at liberty to take legal recourse.
