Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking quashing of FIR No. 0353/2024 registered under Section 109 BNS and Sections 25/27/54/59 Arms Act at P.S. Janakpuri and all the proceedings emanating therefrom. 2.
It is submitted that the Petitioner and the injured Complainant, both of whom are present in the Court are friends and while getting inside the car, the firearm accidently got fired, resulted in a bullet injury in the knee of the Complainant.

Both the parties submit that they have amicably settled the dispute vide Settlement Deed dated 08.01.2025 and seek quashing of the Petition. 4.
Pertinently, it is serious case of firearm injury suffered by the Complainant. Significantly, on the same ground, earlier CRL.M.C. 393/2025 for quashing of the FIR on the same Settlement, had been filed by them, which was withdrawn on account of filing of the Chargesheet. 5.
There is no merit in the present Petition, which has been filed afresh in less than a month's time of the withdrawal of the earlier Petition. Also, considering the gravity of the allegations and the nature of injury, it is not considered a fit case for quashing.

The Petition is accordingly, dismissed.
