O R D E R

Through the present Appeal, the Appellant [Defendant in the pending suit] assails the correctness of an order dated 18.09.2025 [hereinafter referred to as 'Impugned Order'] passed by the learned Single Judge, whereby an ad interim ex parte order was passed, restricting the Defendant from maintaining, continuing, appearing in, or participating in the contempt proceedings pending before the High Court of Singapore.

This Bench, in its detailed judgment dated 12.12.2025 passed in FAO(OS) 88/2025 captioned MSA Global LLC Oman v. Engineering Projects India Ltd, has examined the issue of jurisdiction of the Court with respect to arbitration proceedings. of filing an application for vacation of stay or call upon the learned Single Judge to finally decide the application filed under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure, 1908 [hereinafter referred to as 'CPC'].

At this stage, this Bench does not find it appropriate to interfere with the Impugned Order. However, this Bench deems it appropriate to relegate the Defendant to the remedy available before the learned Single Judge. All issues and contentions are kept open, and needless to observe that the learned Single Judge shall decide the application under Order XXXIX Rules 1 and 2 of the CPC, uninfluenced by the Impugned Order.

With the above observation, the present Appeal is disposed of. The pending applications shall stand closed.
