Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of the Petitioners to correct the title of the Petition from W.P.(CRL) to CRL.M.C. The prayer being technical is allowed.

2023 read with Section 482 of the Code of Criminal Procedure, 1973, has been filed on behalf of the Petitioners for quashing of FIR No. 304/2022 under Section 406/424/34 of IPC registered at Police Station Kotla Mubarakpur.

It is submitted that earlier, the Complainant had entered into a Settlement but has retracted and the quashing is sought on the ground that the dispute is essentially civil in nature.

Learned counsel for the Petitioners, seeks permission to withdraw the present Petition with liberty to raise their contentions before the learned Trial Court.

A prayer is made that the Petitioners be allowed to appear through counsel. However, the Application in this regard be filed before the learned Trial Court, who may consider it, in accordance with law. 7.
The Petition is disposed of accordingly.
