% 03.04.2018 The status report has been submitted on behalf of the State. Arguments addressed on behalf of either side. On behalf of the applicant, it has been submitted that the applicant has been falsely implicated in the instant case on the complaint of the complainant and all allegations levelled against the applicant of having thrown boiling tea on the complainant which boiling tea had also fallen on to his wife are false and erroneous.
Without any observations on the merits or demerits of the case, it is essential to observe that the MLC on the record as submitted on behalf of the State indicates that there are burns even on the back of the neck of the injured- complainant/ Kundun Lal and there are injuries also on the person of the wife of the complainant. The contention that has been raised on behalf of the applicant is to the effect that the attempt was made by the complainant to throw the tea
on to the applicant which rather had fallen on to the complainant and on his wife which at this stage is prima-facie negated by the injuries being on the back of the neck of the complainant. Learned counsel for the applicant submits that the charge-sheet in the instant case has been filed. Taking the gravity of the allegation levelled against the applicant into account of burning tea having been poured on to the complainant which had fallen on to his wife, there is no ground of grant of bail.
The application is declined.
