Counsel appears on behalf of the respondent no.2 and submits that the respondent no.2 has no intention at this stage to invoke the bank guarantee of Rs.2,58,65,362/-, provided the petitioner keeps alive the bank guarantee. 2.
Mr. Ashish Aggarwal, counsel appearing on behalf of the petitioner is agreeable to keeping the bank guarantee alive. 3.
Mr. Aggarwal, submits that the petitioner shall invoke Arbitration clause within one (1) week from today.

The parties shall be bound by the aforesaid statements. 5.
Accordingly, the petitioner is directed to keep the bank guarantee alive till further orders that may be passed in the arbitral proceedings. 6.
Subject to the aforesaid, the respondent no.2 shall not invoke the bank guarantee till orders are passed in this regard by the Arbitral Tribunal. 7.
The petition along with all pending applications is disposed of with the aforesaid directions.
