This petition is filed by the Petitioner for substitution of the Arbitrator on the ground that learned Arbitrator appointed by this Court on 08.04.2025 by consent of parties under a petition filed under Section 9 of the Arbitration and Conciliation Act, 1996 ('1996 Act') being OMP. (I) (COMM.) 123/2025 has been elevated as a Judge of the High Court. 2.

Learned counsel for the Respondent has no objection to the substitution. He, however, draws the attention of the Court to Rule 11 of the Delhi International Arbitration Centre (Arbitration and Procedural Rules), 2023 which provides that in case of any substitution, the Arbitrator will be appointed by the Chairperson of DIAC. In light of this, this petition is disposed of terminating the mandate of the Arbitrator and directing the Chairperson of the DIAC to appoint a substitute Arbitrator. The substitute O.M.P. Arbitrator shall resume proceedings from the stage at which the proceedings were left by the erstwhile Arbitrator.

Learned Arbitrator on appointment shall give disclosure under Section 12 of the 1996 Act before entering upon reference. 4.

It is made clear that this Court has not expressed any opinion on the merits of the case and all rights and contentions of the respective parties are left open.
