The present writ petition has been filed seeking directions to the respondent nos. 1 and 2, to stop the unauthorized and illegal demolition of the portion of the property bearing Municipal No. 4733, Gali Razia Begum, Hauz Qazi, Delhi-110006.

Learned counsel for the petitioner submits that the petitioner resides in the property in question, admeasuring approximately 200 Sq. yards, which is constructed in two portions. She submits that 50 % of the said property in question is occupied by the petitioner, while the other half is occupied by respondent no. 3, who is the brother-in-law of the petitioner. 3.

Attention of this Court has been drawn to photographs attached with the petition, to show that on account of the demolition, the constructed portion of the property in question, under the occupation of the petitioner, is being affected.

She further submits that, in case the stairs are also demolished by the respondent no. 3, the ingress and egress of the petitioner shall be completely hindered. One of the photographs, as shown to this Court, is reproduced as under:

Responding to the present writ petition, learned counsel appearing for the Municipal Corporation of Delhi ("MCD"), on instructions, submits that as of today, there is no application before the MCD for sanction of any building plan.

He further submits that the present writ petition can be treated as a representation.

Accordingly, it is directed that the present writ petition shall be treated as a representation by the MCD. The petitioner shall be granted a hearing by the Deputy Commissioner, City SP Zone, MCD. 8.

At the time of the hearing, MCD shall also consider the fact that the demolition being undertaken is in a part of one big plot, wherein, 50% of the area is under the occupation of the petitioner. 9.

Further, the MCD shall ensure that on account of any demolition activity, the ingress and egress of the petitioner, is not hindered in any manner. The MCD shall ensure that the staircase leading to the property of the petitioner is not demolished, so that the ingress and egress of the petitioner to her property, is not obstructed in any manner. 10.

The MCD shall also ensure that any action by respondent no. 3, shall be in accordance with law.

At the time of the hearing to the petitioner, the Deputy Commissioner, City SP Zone, MCD shall also call respondent no. 3, for hearing. 12.

After granting hearing to the petitioner as well as respondent no. 3, in case need be, requisite action shall be taken by the MCD, in accordance with law.
