The present writ petition has been filed seeking directions to the respondent-Municipal Corporation of Delhi ("MCD"), to demolish the illegal and unauthorized construction being carried out in the property bearing House No. 64, Top Floor, Shanti Vihar, Karkardooma, Delhi110092. 2.
Learned counsel for the petitioner has drawn the attention of this Court to various photographs attached with the petition to show the existence of unauthorized construction in the property in question. 3.
Responding to the present writ petition, learned counsel for the respondent MCD submits that as per the available record, with respect to the property in question, a Sanction Plan had been obtained earlier.

question. The same was accordingly booked for unauthorized construction on 31st March, 2022. Subsequently, a Demolition Order was passed on 04th May, 2022, after following the due process of law. 4.
It is submitted that a demolition programme was fixed by the MCD and on 25th May, 2022, partial demolition action was taken. Subsequently, demolition action was also taken on 02nd January, 2024. He, thus, submits that further demolition action is now fixed for 24th October, 2025. 5.
The Status Report as filed on behalf of the MCD is taken on record. 6.
Having heard learned counsels for the parties, it transpires that the MCD has already taken part-action against the unauthorized construction on 25th May, 2022 and 02nd January, 2024. Further, the next demolition action is now fixed for 25th October, 2025.

Accordingly, it is directed that the MCD shall carry out the requisite demolition action and ensure that the unauthorized construction on the terrace of the fourth floor of the property in question is demolished completely.

In case, the petitioner is aggrieved by any non-action on the part of the MCD, the petitioner shall be at liberty to approach the Special Task Force ("STF") as constituted by the Supreme Court, in terms of the orders passed by the Division Bench of this Court in the case of Devender Versus Govt. of NCT of Delhi and Ors., and other connected matters, in W.P.(C) 1807/2018, and Fazruddin Versus DDA and Ors., in W.P.(C) 4649/2017. 9.
Status of any action taken by the MCD shall be duly uploaded on the website of the STF.
