% 13.10.2017 The learned counsel for the plaintiff submits that the defendant has published the apology as was agreed and noted in the order dated 19.09.2017 and they have already received the damages to the tune of Rs.4.00 lac by way of demand draft. Nothing survives in the present matter.

Since the matter has been amicably settled between the parties, the plaintiff shall be entitled to the refund of the Court Fees per Section 16 of the Court Fees Act.

The suit of the plaintiff is disposed of as settled in above terms. Parties to bear their own costs.
