Applicant seeks anticipatory bail in case FIR No.261/2025 dated 16.06.2025 registered at P.S Pandav Nagar for commission of offences under Sections 69/351/3(5) of Bharatiya Nyaya Sanhita (BNS), 2023. 2.
On the last date, there was no appearance from the side of the applicant and the matter was adjourned for today while observing as under:- "1.
As per the office report, no fresh affidavit has been filed by the applicant.

When the present matter was taken up by this Court on 18.02.2026, it was contended from the side of applicant that the victim was already married and such fact was seriously disputed by the respondent as well as by the prosecutrix and, therefore, the applicant was directed to clarify as to on what basis, the abovesaid contention had been made by him. So much so, during course of arguments, the applicant had submitted that he had joined the investigation and his mobile phone has also been seized whereas the abovesaid assertion was found to be incorrect and, therefore, BAIL APPLN. 3896/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the applicant was directed to give requisite clarification by filing an additional affidavit.

None appears on behalf of applicant and there is no compliance of the abovesaid direction. It seems that either the applicant has lost interest in pursuing the present application or he does not want to comply with the abovesaid direction.

As per allegations appearing in the record, he had made physical relationship with the complainant on several occasions on the pretext of marrying her.

In the interest of justice, one last and final opportunity is granted to applicant to submit an affidavit in terms of the abovesaid directions, failing which this Court would be constrained to dismiss his application." 3.
It is clear that the applicant has lost interest in pursuing his present application and, therefore, the application is, hereby, dismissed-in-default. 4.
It is, however, made clear that since the application is being dismissed-in-default, there is no observation on the merits of the case.
