Applicant seeks regular bail in case FIR No. 191/2020, registered at Police Station Hazrat Nizamuddin, New Delhi, for commission of offences under Section 376 of Indian Penal Code, 1860 and Section 6 of Protection of Children from Sexual Offences Act, 2012.

As per nominal roll, accused was taken to jail on 28.07.2020 and continues to be incarceration in the present matter. His present age is 34 years and nominal roll does not record any previous involvement of any nature whatsoever. He has been in custody for last five and half years. 3.
Case pertains to sexual assault and the allegations against applicant/accused are that he has committed such sexual assault upon his real sister.

Admittedly, his two sisters, including the victim, have already been examined. As far as the mother of victim is concerned, she has been dropped by the prosecution and, therefore, she would not be entering into witness-box. It is apprised that victim has already married and despite best efforts made by the investigating officer, he could not contact her. 6.
There are, reportedly 24 witnesses (including the witnesses mentioned in supplementary charge-sheet) and so far only 07 witnesses have been examined.

Keeping in mind the long incarceration period and the fact that since victim has already been examined, there is no apprehension of the accused trying to influence her and his previous clean antecedents, applicant is admitted to bail on his furnishing personal bond and surety bond in a sum of Rs. 25,000/- each subject to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Judicial Magistrate First Class with the following conditions: - (i) Applicant shall not try to contact his sisters in any manner, directly or indirectly.
(ii) Applicant shall report to the SHO of the local area, once a week on every Sunday at 10:00 AM and shall not leave the National Capital Territory of Delhi without prior permission of learned Trial Court. (iii) Applicant shall furnish a mobile number to concerned IO on which he can he contacted, if required. Such number shall remain operational and functional.

Application stands disposed of in aforesaid terms. 9.
