The present petition is filed seeking quashing of FIR No. 305/2012 dated 30.11.2012, registered at Police Station Zafrabad, for offences under Sections 406/420/506/120B/34 of the Indian Penal Code, 1860 ('IPC'), and all consequential proceedings arising therefrom.

The FIR was registered on a complaint given by Respondent No. 2. It is alleged that on 21.07.2012, the complainant came across an advertisement in a newspaper which stated that the applicant could earn good money and a phone number was also provided for enquiry purposes. ₹30,000/- to ₹40,000/- per month. It was however represented to the complainant that he needed to deposit ₹60,000/- as security. The said Vikas thereafter gave the account numbers of the petitioners to the complainant to make the deposit of the said amount. It is alleged that thereafter, the complainant deposited the amount in two instalments into the given bank accounts. It is alleged that thereafter when the complainant tried to contact the accused persons, they threatened him of dire consequences. The said incident culminated into the registration of the present FIR. 3.

The present petition is filed on the ground that the parties have amicably settled all their disputes by way of Memorandum of Settlement dated 13.06.2025, of their own free will, without any force, pressure or coercion.

Chargesheet has already been filed in the present case. 5.

The parties are present in person in Court and have been duly identified by the Investigating Officer. 6.

On being asked, the complainant states that the dispute has already been settled and he no longer wishes to pursue any proceedings arising out of the present FIR. He submits that he has received the entire settlement amount and is satisfied with the same. He further states that he has no objection if the FIR and the consequential proceedings arising therefrom are quashed. 7.

Offences under Sections 406/420/506 of the IPC are compoundable in nature.

In view of the fact that the complainant is present in Court and states that he does not wish to pursue any proceedings arising out of the present FIR, this Court is of the opinion that no useful purpose would be served by relegating the parties to the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Keeping in view the nature of dispute and that the parties have amicably entered into a settlement, this Court feels that no useful purpose would be served by keeping the dispute alive and continuance of the proceedings would amount to abuse of the process of Court.

However, keeping in mind the fact that the chargesheet has been filed and that the State machinery has been put to motion, ends of justice would be served if the petitioners are put to cost. 11.

In view of the above, FIR No. 305/2012 and all consequential proceedings arising therefrom are quashed, subject to payment of a total cost of ₹20,000/- by the petitioners (₹10,000/- by each petitioner) to be deposited with the Delhi Police Martyrs' Fund within a period of twelve weeks from date. 12.

Let the proof of deposit of cost be submitted to the concerned SHO.
