Learned counsel appearing on behalf of the parties jointly submit that during the pendency of the present suit, the parties have arrived at a settlement, terms whereof have been recorded in the form of settlement agreement dated 25.04.2026 which has been marked as Ex.P1 in the statement of the parties separately recorded by the learned Joint Registrar on 29.04.2026.

Plaintiff as well as defendant no.2, in their respective statements clearly affirmed the factum of settlement.

In view of the above settlement, learned counsel appearing on behalf of the plaintiff seeks to withdraw the present suit. 4.
The suit is dismissed as withdrawn.

submits that since the present suit has been disposed of in light of the settlement, court fee affixed by the plaintiff on the plaint may be refunded. 6.
Having regard to the fact that the parties have arrived at a settlement, and the suit has been disposed of in terms thereof, this Court is of the view that the plaintiff is entitled to refund of full court fees affixed on the plaint in terms of the Gazette Notification dated 06.03.2026 published by the GNCTD vide Notification No. F.14 (105)/LA-2026/ jtsecylaw /359-368 titled "The Court Fees (Delhi Amendment) Act, 2026" 7.
Accordingly, the Registry of this Court is directed to issue a certificate to the plaintiff for refund of full court fees. 8.
Pending applications stand disposed of.

The dates fixed before the learned Joint Registrar on 03.08.2026 and before this Court on 11.08.2026, stand cancelled.
