Learned counsel representing the respondent-MCD has stated that the tender has been awarded to Mr.Abhay Kumar Singh; Address: B-365/2, Block-B, Rajvir Colony, Gharoli Extension, New Delhi - 110096; Contact No.9971926233; Email: abhay.kur2009@gmail.com. 3.

Mr.Tanmay Mehta, learned counsel appearing for the petitioner states that in view of the later developments which have taken place after filing of the writ petition, the petition needs to be amended. He has further stated that Delhi State Industrial and Infrastructure Development Corporation Limited will be a necessary party.

At this juncture, learned counsel for the petitioner prays that the petitioner may be permitted to withdraw the instant writ petition with liberty to file a fresh petition without prejudice to his rights in the instant petition.
