The present writ petition has been filed seeking directions to the respondent no. 1-Municipal Corporation of Delhi ("MCD"), to take steps, in accordance with law, against the illegal and unauthorized construction being carried out by respondent no. 2, in the property situated at D-23, Gali No. 3, Block-D, Khanpur Extension, District South, New Delhi-110062. 2.

Responding to the present writ petition, learned counsel appearing for the MCD submits that a Show Cause Notice against the unauthorized construction in the property in question, has already been issued on 26th September, 2025.

He further submits that a Work Stop Notice has also been issued on 30th September, 2025.

Accordingly, the MCD is enjoined upon to take requisite action against the unauthorized construction existing in the property in question, after following the due process, in accordance with law. 5.

In case, the petitioner is aggrieved by any non-action on the part of the MCD, the petitioner is at liberty to approach the Special Task Force ("STF") as constituted by the Supreme Court, in terms of the orders passed by the Division Bench of this Court in the case of Devender Versus Govt. of NCT of Delhi and Ors., and other connected matters, in W.P.(C) 1807/2018, and Fazruddin Versus DDA and Ors., in W.P.(C) 4649/2017. 6.

In case, respondent no. 2, i.e., owner/occupier of the property in question is aggrieved by any action taken by the MCD, the right of the said respondent to seek remedies, in accordance with law, is reserved. 7.

It is further directed that the MCD, along with the assistance of the local police shall ensure that no further unauthorized construction takes place in the property in question.

With the aforesaid directions, the present writ petition, along with the pending application, is accordingly disposed of.
