W.P.(CRL) 848/2018 Petitioners are seeking quashing of the present FIR i.e. the FIR No.0633/2016 registered under Sections 323/354/34 of the IPC at police station Shakarpur on the complaint of respondent no.2. It is stated that the parties have now settled their disputes and this complaint had really emanated out of a property transaction between the husband of the complainant and the petitioners. Respondent no.2 and the petitioners are present in the Court today. They endorsed this
fact. Respondent no.2 states that this complaint had been filed out of a misunderstanding.
Learned counsel for the State on advance notice has put in appearance. His submission is that the investigation has progressed and the charge sheet is already ready; if at all the prayer made in the petition is to be allowed it should be subject to costs as the investigating agency has incurred some kind of useless expenditure. Noting these above noted facts while allowing the prayer made in the petition and quashing the FIR No.0633/2016 registered under Sections 323/354/34 of the IPC at police station Shakarpur and all the proceedings emanating therefrom the petitioners are burdened with costs of ₹25,000/- to be deposited with the Delhi High Court Legal Services Committee.
Petition disposed of in the above terms.
