CRL.M.A. 34959/2025 under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for staying the operation Order dated 14.11.2025 passed by learned MM in 5CC NI ACT/199/2024 titled as Vijay Singh Mawari vs. Ram Avtar Tyagi, wherein FIR has been directed to be registered under Section 209 BNS. 4.

Learned ASC for the State appears on advance Notice. 5.

After some arguments, learned counsel for the Petitioner seeks permission to withdraw present Application as well as main Writ Petition, with liberty to challenge the impugned Order before the learned Sessions Court, in accordance with law.
