The present petition has been filed on behalf of the petitioners seeking quashing of FIR No. 40/2020 registered under Sections 498-A/406/377/34 IPC at P.S. Tilak Marg, New Delhi on the ground that the parties have amicably settled their disputes.

The present FIR is an outcome of a matrimonial dispute between the complainant/respondent No. 2 (wife) and petitioner No.1 (husband), whereas petitioner Nos. 2 & 3 are the in-laws of respondent No.2. 3.

Mr. Shoaib Haider, learned APP for the State, submits that in the present case the petitioners are the only accused and respondent No. 2 is the complainant/victim. He states that the allegations under Section 377 IPC are only against the petitioner No.1 (husband). He further submits that the chargesheet has been filed in the present case. Learned counsels for the parties submit that after ironing out their differences the parties have settled their disputes vide Settlement Agreement dated 25.10.2024 and are living together since 2020. 5.

Petitioners are present in Court and have been identified by their counsel as well as by the I.O./ SI Clara PS Tilak Marg, New Delhi. Respondent No. 2, who is also present in Court, has been identified by the I.O. Respondent No. 2 states that she has been living with her husband i.e., petitioner No.1 since 2020 and as of now she has no complaint against her husband. She further states that she is giving this statement out of her own free will, volition and without any coercion. She also states that she has no objection if the present FIR and the consequent proceedings are quashed. 6.

Learned counsels for the parties submit that no other proceedings are pending between the parties.

The parties shall remain bound by the statements and undertaking made in Court today.

In view of the above facts and since no useful purpose will be served in continuance of the present criminal proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed.

With the above directions, the petition is disposed of along with pending application.
