The petitioner assailed dismissal of his application under Section 156(3) CrPC and sought directions to the learned trial magistrate to immediately take cognizance of the complaint. But after addressing partly, learned counsel for petitioner seeks permission to withdraw this writ petition since the matter is already pending before the trial court at the stage of presummoning evidence. 2.

Accordingly, the petition is dismissed as withdrawn making it clear that I have not examined the merits of the petition.
