By the order under appeal, the learned Single Judge declined to grant the prayer in C.M.No.46062/2016 in W.P.(C) No.11696/2016 and directed to list the main petition on 02.08.2017 to enable the pleadings to be completed.

We have heard the learned counsel for the appellant/writ petitioner as well as the learned counsels appearing for the respondents. 3.
Having regard to the nature of the controversy involved in the main petition, we are of the view that the interim relief as prayed for cannot be granted unless and until the main writ petition is heard on merits. The learned Single Judge therefore was justified in rejecting the miscellaneous application.

However, in the facts and circumstances of the case, it appears to us that the main petition requires expeditious disposal. The learned counsels for both the respondents undertake to file their respective counter affidavits within two weeks. Rejoinder, if any, within two weeks thereafter. 5.
The writ petition be listed before the learned Single Judge on 17.04.2017 for directions. We request the learned Single Judge to decide the main writ petition expeditiously.

The date already fixed as 02.08.2017 in the writ petition shall stand cancelled.

The appeal is accordingly disposed of.
