1. This is the joint application on behalf of the parties under Order 23 Rule 1 & 3 read with section 151 CPC praying for a compromise decree in view of the of the amicable settlement arrived at between the parties.

2. The application may be numbered and taken on record.

3. The present suit is for declaration, partition, rendition of accounts in respect of the properties mentioned in para 2 of the application, listed below:- (i) Property bearing No. 4893, Sachar Building, Phoota Road, Sadar Bazar, Delhi- 110006.

(ii) Two shops bearing No. 5525 and 5526 forming part of property bearing No. 73, G.B. road, New Delhi.

(iii) Shop bearing No. 1532, G.B. Road, New Delhi. (iv) Godown bearing No. 1528 Farash Khana, G.B. Road, New Delhi110006. (v) House bearing No. E-112, Preet Vihar, New Delhi.

4. During the pendency of the suit, the parties have amicably settled all their disputes and differences in respect of the aforesaid suit properties in accordance with the terms and conditions mentioned in para 4(a) to 4(f) of the application.

5. All the parties to the settlement have filed their respective affidavits and are also present before the Court today.

Learned counsels for the parties have also signed the application and support the settlement and jointly pray that the matter may be disposed of in terms of the settlement arrived at between the parties. Learned counsel for the parties further inform that in terms of the settlement, an amount of Rs. 14, 5000/- has been paid by all the Defendants to the Plaintiffs by way of four cheques and the keys of the godown are also handed over to the Plaintiff, who confirms the receipt thereof.

6. I have perused the compromise/settlement arrived at between the parties and find the same to be lawful.

7. A decree is passed, in terms of the settlement, which along with the

Annexure thereto shall form part of the decree sheet.

8. Decree sheet be prepared.

9. A certificate entitling the plaintiff to refund of court fees be issued and handed over to the counsel for the plaintiff. SANJEEV NARULA, J MAY 20, 2019/ss
