% 24.05.2016 During the course of arguments partly advanced, learned senior counsel for the petitioner has submitted that now the matter is pending in the Court of learned Chief Metropolitan Magistrate as the Special Judge under the Prevention of Corruption Act has not taken the cognizance of the matter.
Undisputedly, no application has been moved in the Trial Court for grant of bail.
In the facts and circumstances, learned counsel for the petitioner wishes to withdraw the present petition with liberty to approach the learned CMM for the grant of bail. Consequently, the present petition is dismissed as withdrawn
with liberty to learned senior counsel for the petitioner to move the application for the grant of bail before the learned CMM. It is made clear that while considering the bail application, the learned CMM shall not be affected by the earlier orders of the Court below and the orders passed by the High Court. Dasti.
