% 15.03.2018 Present suit has been filed for declaration praying that the judgment and order dated 04th September, 2017 passed by this Court in CS(OS) 522/2016 is null and void.

After some arguments, as the learned counsel for plaintiff realises that the impugned judgment is a judgment in personam and the plaintiff can file objections under Order XXI in the event an execution proceeding is filed against him and/or he is adversely affected by any order passed in the said execution, he wishes to withdraw the present suit with liberty to raise objections as may be available to the plaintiff in accordance with law at the appropriate stage.

With the aforesaid liberty, present suit and pending applications are dismissed as withdrawn.
