The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.444/2016 registered under Sections 498A/304B/34 IPC at PS Khyala. Status report is on record. 2.

I have heard the learned counsel for the parties and have examined the file. The petitioner is a widow. She was married to one Jagdish at the age of 13 years. It is informed that Jagdish died when the petitioner was 15 years old and she did not marry thereafter. She is living with her father at N-31, Gali No.2, Vishnu Garden, New Delhi.

She is daughter of maternal uncle of the husband of the deceased.

It is informed that the petitioner has since joined the investigation in compliance of the order dated 15.11.2016 of the Trial BAIL APPLN. 362/2017

Court. No specific allegations have been levelled regarding demand of dowry and harassment to the victim by the present petitioner. It is informed that at the time of incident i.e. 24.10.2016 she was not even present in the house and was at Mishra Clinic for her own treatment. In the FIR, no specific role has been assigned to the petitioner. Victim's husband is already in custody.

Considering the facts and circumstances of the case, the petitioner is granted anticipatory bail and in the event of arrest, she be released on furnishing personal bond in the sum of ` 50,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer. She shall, however, join the investigation as and when required.

The bail application stands disposed of.
