Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the Petitioners seeking quashing of FIR No. 0308/2025 registered under Sections 420/34 IPC at P.S. Sarai Rohilla and all proceedings arising therefrom in terms of the Settlement Agreement dated 16.08.2025.

Learned APP appearing on advance Notice, accepts Notice on behalf of the State. Learned Counsel for the Respondent No. 2 has appeared through VC and accepted the Notice.

The FIR No. 0308/2025 was lodged under Sections 420/34 IPC at P.S. Sarai Rohilla on the basis of Complaint made by the Complainant for cheating committed by the Petitioners.

The parties have appeared through VC and have been identified by the Investigating Officer. Chargesheet has still not been filed in the Court. 5.

It is submitted that Respondent No. 2 and Petitioners had entered into business transaction and dealings in supply of Stainless Steel Scrap but the dispute arose when the Petitioners defaulted in fulfilling their obligations of supplying the material to the Respondent No. 2 worth Rs.1,05,00,000/-. 6.

It is submitted that the matter is settled in terms of Settlement Agreement dated 16.08.2025 and Complainant has received all the amount, who endorses the Settlement.

It is submitted on behalf of the Complainant that he has no objection if the FIR is quashed against the Petitioners on account of the Settlement already arrived at between the parties voluntarily, without any fear or coercion.

Learned Prosecutor has no objection to the quashing of FIR in terms of the Settlement.

In view of the submissions made and that the matter is amicably settled between the parties, FIR No. 0308/2025 registered under Sections 420/34 IPC at P.S. Sarai Rohilla with all the subsequent proceedings, is hereby quashed.

Both the parties are directed to deposit the cost of Rs.25,000/- with the Delhi High Court Advocates' Welfare Trust. 11.
