A Petition under Section 528 and 529 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner Trust with the prayer that the learned Trial Court be directed to dispose of the Chargesheet filed in FIR No.261/2018 PS EOW Cell, Delhi under Section 420/406 IPC in a time bound manner within six months or any time period which the Court may deem fit and proper.

The List of Dates filed along with the Petition shows that the Chargesheet had been filed in the Court on 01.03.2021. Accused made an appearance and the arguments were heard on the Bail Application on 09.03.2022, but thereafter they absented themselves on 31.03.2022. Consequently, NBWs were directed to be issued and the Sureties were bound down. There was no stay of the proceedings and the Warrants were issued again on 08.04.2022 and 06.05.2022. Thereafter, the Accused appeared and the matter was listed for arguments on Charge on 22.07.2022 for 27.10.2022. Part arguments were heard on 19.10.2023 and 09.02.2023. However, the Accused persons again absented themselves and Warrants were issued against them on 21.03.2024. The Accused put in their appearance on 29.08.2024. The matter was again taken up on 04.01.2025 for clarifications/assistance on the point of Charge. The Accused put in appearance on 05.04.2025 and again made a prayer for adjournment on 05.07.2025.

The details shows the manner in which the trial has proceeded. It appears that on some dates the Accused had failed to appear and the Warrants had to be issued. It is for the Trial Court to take appropriate steps to ensure that no unnecessary dates are given and to take stringent action in the matter. The conduct of the Accused shows a dereliction or any endeavour to delay the proceedings. No further direction is required except that considering that the Chargesheet got filed in 2021, the proceedings may be conducted in an expeditious manner.
