O R D E R

The present petition has been filed under Section 528 BNSS, 2023 seeking quashing of FIR No.0051/2022 under Section 420/120B IPC, registered at Cyber Police Station Dwarka and all consequential proceedings emanating therefrom, on the ground that the parties have arrived at a settlement.

Petitioner as well as, respondent no.2 are present in Court and they have been identified by the learned counsel for the petitioner as well as SI Tej Singh Rathee, Police Station - Dwarka.

main accused, who met the complainant's daughter through Jeevansathi.com and informed her that he works in a company based in Dubai which provides visas. He assured her that he can get Dubai Visas issued for her and her family members and demanded Rs.70,000/- per person for the same. The victim (complainant's daughter) paid him a total amount of Rs.4,31,000- on behalf of her and her family members. One of the accounts in which the money was transferred belongs to the petitioner herein. When the victim did not get the visas, she contacted the Dubai company, which informed that the petitioner's brother (main accused) only worked there for a period of one and half years on a temporary basis and upon receiving such information, the complainant's daughter realized that she has been defrauded, which led to the registration of the present FIR.

During pendency of the proceedings, the parties have resolved all their disputes amicably without any coercion or pressure and some money has been returned to the victims.

The complainant is present through VC. On a query posed by the Court, he states that he has settled the matter with the petitioner herein and does not want to prosecute the criminal proceedings any further and has no objection in case the FIR is quashed.

In view of the fact that the petitioner as well as respondent no.2 have amicably settled their disputes and regard being had to the statement made by complainant, this Court is of the view that no useful purpose will be served in continuation of criminal proceedings and it will be an exercise in futility.

At this stage, apt would it be to refer to the observations of the Supreme Court in Gian Singh v. State of Punjab, (2012) 10 SCC 303: The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

(SCC p. 340, para 58) "58. Where the High Court quashes a criminal proceeding having regard to the fact that the dispute between the offender and the victim has been settled although the offences are not compoundable, it does so as in its opinion, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor."

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 10.

Consequently, the petition is allowed and the FIR No.0051/2022 under Section 420/120B IPC, registered at Cyber Police Station Dwarka alongwith all other proceedings emanating therefrom, is quashed. 11.

The petition along with pending application stands disposed of in the above terms.
