The present petition under Section 29A(4) of the Arbitration and Conciliation Act, 1996 has been filed by the Petitioner for extending the mandate of the Arbitral Tribunal.

Material on record indicates that an Arbitral Tribunal was constituted by this Court on 02.06.2021 in an arbitration petition being ARB.P. 1250/2023 filed by the Petitioner. The pleading stood complete on 01.06.2024. The period of one year got over on 01.06.2025. There is nothing on record to show that the parties have extended the mandate by giving consent, however, the proceedings have continued and the last of the Order as produced before this Court is dated 30.08.2025 passed by the Arbitral Tribunal.

Paints India Limited, 2024 SCC OnLine SC 2494, has held that an application for extension of the time period for passing an arbitral award under Section 29A(4) read with Section 29A(5) is maintainable even after the expiry of the twelve-month or the extended six-month period, as the case may be.

In view of the fact that the cross-examination of the witnesses of the Respondents is complete, this Court is inclined to regularize the period till today and extend the mandate of the Arbitral Tribunal till 31.10.2026, so that the award can be pronounced.

The petition is disposed of, along with the pending applications, if any.
