The present petition under Section 25-B(1) of the DRC Act, 1958, seeks the following prayers:- "i. Set-aside the impugned order dated 09.05.2025 passed by the Hon'ble Court of Ms. Arjinder Kaur, SCJ-cum- RC(central), Tis Hazari Court, Delhi Eviction Petition No Rc ARC No. 78606/2016 titled Ashok Kumar Jain (Sr. Citizen) vs Sh. Gurpreet Singh and consequent thereto dismiss the eviction petition filed against the respondent herein.
ii. Award Costs of the proceedings in favour of the petitioner and against the Respondent;
iii. Pass any such or further order that this Hon'ble Court as may be deemed fit and proper in the facts and circumstances of this present case."

Learned counsel appearing on behalf of the petitioner submits that during the pendency of the present petition, the parties have arrived at a settlement before the learned Executing Court, and it is further submitted that the petitioner shall vacate the subject premises by 05.07.2026. 4.
It is further pointed out that petitioner shall also pay rent in terms of the said settlement to the respondent.

In view of the above, learned counsel for the petitioner seeks leave of this Court to withdraw the present petition.

Leave granted.

The present petition is dismissed as withdrawn and disposed of accordingly.
