O R D E R

% 01.09.2017 Learned counsel for the petitioner submits that the prosecutrix was about 18 years of age at the time of the incident. He submits that in her first statement contained in DD No.33-B dated 09.06.2015, the prosecutrix had disclosed her age as 17 years 11 months and 9 days. It is further submitted that in her first statement the prosecutrix had neither named the petitioner nor any allegations of rape have been alleged against him. Learned counsel for the petitioner further submits that in her first statement grievance shown by the prosecutrix was that she had not been treated well by the person who had brought her from Jharkhand to Delhi and

also by her employer with whom she got employment through a placement agency. It is further submitted that it is only in the supplementary statement, recorded on 10.06.2015, the prosecutrix stated that in the month of December, 2014 the petitioner had come to her room and had established physical relations with her without her consent. The FIR in the present matter was lodged in the month of June, 2015, that is, after about six month of the alleged incident. The petitioner is in custody since 26.06.2015, that is, for more than two years. Keeping in mind the totality of circumstances, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of ` 10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of the trial court, with the condition that he will not contact the witnesses of the case.

Bail application is disposed of in the above terms. Dasti.
