The present writ petition has been filed seeking directions to respondent nos. 1 to 4 to remove the illegal and unlawful construction, being raised by respondent no. 5, over the property, i.e., land area measuring 58 sq. yards, comprising in Khasra No. 93/2, situated in the area of Azadpur, Abadi known as Mandir Wali Gali, House No. 181/4, Azadpur, North-West, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Responding to the present writ petition, learned counsel appearing for respondent-Municipal Corporation of Delhi ("MCD"), submits that the property in question is an old property and that respondent no. 5 herein has only repaired the roof of the property, which was in a dilapidated condition. The said repairing of the roof as carried out by respondent no. 5, is permissible.

This Court further records the statement made by learned counsel appearing for respondent-MCD that the construction is an old one and that no fresh construction, as such, has been carried out, except repair of the roof. 7.

This Court is further informed that ownership dispute is going on between the petitioners and respondent no. 5. 8.
