The present petition under Articles 226 and 227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (corresponding to Section 482 of the Code of Criminal Procedure, 19732) seeks quashing of FIR No. 438/2025 dated 8th June, 2025 registered under Sections 75 and 79 of the Bharatiya Nyaya Sanhita, 20233 at P.S. Begum Pur, Delhi and all other proceedings emanating therefrom. petition has been filed on the basis of a purported compromise between the Petitioner and the Complainant/Respondent No. 2. 2.
Although the petition is supported by a Settlement Agreement dated 7th August, 2025, and an Affidavit/No Objection Certificate, the Complainant/Respondent No. 2, who is present in person and duly identified by the Investigating Officer, states that she does not support the prayer for quashing. She admits executing the Affidavit in support of the petition but asserts that doing so was a mistake and that she does not consent to the quashing of the FIR.

In light of the above, the Court finds no ground to accede to the Petitioner9s request. The present petition is, therefore, dismissed. 4.
It is, however, clarified that the observations made herein are confined solely to the adjudication of the present petition and shall not, in any manner, affect the rights and contentions of either party, which shall be decided independently on their own merits and in accordance with law. 5.
Accordingly, the petition is disposed of along with pending application(s).
