O R D E R

The present petition has been filed seeking mandamus for grant of parole to the petitioner for a period of 60 days in connection with FIR No. 392/2015 under Section 376/506 IPC & under Section 6 of POCSO, registered at PS Hari Nagar.

Learned counsel appearing on behalf of the petitioner submits that an application seeking parole was submitted by the petitioner on 04.09.2025 and the same has not been considered and decided till date, by the respondent.

Learned Additional Standing Counsel on behalf of the State, however, submits that the said application is still under consideration. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Mr. Siddharth Yadav, learned counsel appearing on behalf of the petitioner submits that after the petitioner was convicted, he preferred the Criminal Appeal No. 813/2023 before this Court and the same was dismissed vide judgment dated 22.08.2025.

He submits that the petitioner is seeking parole only for the purposes of filing Special Leave Petition (SLP) before the Hon'ble Supreme Court to assail the judgment in the appeal.

Having regard to the submissions made by Mr. Yadav, as well as the averments made in the petition, the present petition is allowed and the petitioner is granted parole for a period of four weeks. 7.

Accordingly, it is directed that the petitioner be released on parole for a period of four weeks from the date of his release subject to his furnishing a Personal Bond in the sum of Rs. 25,000/- and one surety bond of the like amount to the satisfaction of the Jail Superintendent, further subject to the following conditions:- (a) The petitioner shall not leave city/NCR region without informing the local SHO; and (b) The petitioner shall provide his mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned. 6.

Upon expiry of period of four weeks as stated above, the petitioner shall surrender before the Jail Superintendent. 7.

The petition is allowed, in the above terms.

Copy of the order be forwarded to the Jail Superintendent for information and necessary compliance.
