% 02.03.2017 Present contempt petition has been filed alleging wilful disobedience of the order dated 17th November, 2016 passed in W.P.(C) 779/2014 whereby the order dated 6th September, 2013 passed by the Central Administrative Tribunal [for short "CAT"] directing the respondent-DTC to consider regularisation of petitioner's service against direct quota vacancies against the post for which he is medically suitable and to prepare a Scheme to this effect, was affirmed with a clarification that the Scheme should not be prepared for the petitioner alone.
Learned counsel for the petitioner states that respondents have not complied with the order within two months as directed by the Division Bench.
Keeping in view the fact that present proceedings arise from an order passed by the CAT and the doctrine of merger applies, present contempt petition is disposed of with liberty to the petitioners to file a petition under Section 17 of the Administrative Tribunals Act, 1985. The rights and contentions of all parties are left open.
