This hearing has been done through hybrid mode. 2.

This is an application under Section 482 BNSS, 2023/Section 438 Cr.P.C, 1973 filed on behalf of the applicant, Ms. Monika Dagar, seeking anticipatory bail in connection with FIR No. 557/2025 registered at P.S. Fatehpur Beri for offences under Sections 115(2)/351(3)/127(6)/3(5) of the BNS, Section 6 POCSO Act and Section 75 JJ Act. 3.

The brief facts of the case are that the FIR was lodged on a complaint by the mother of a minor child aged about seven years (victim), alleging that the applicant had sexually assaulted the minor victim of the complainant. 4.

The applicant contends that she has been falsely implicated due to ongoing matrimonial disputes between the complainant and her husband, Ankur Malik.

Issue notice. Learned APP for the State enters appearance and accepts. 6.

It is submitted by learned APP for state, that as per information given by SI Suruchi, Investigating Officer, applicant has joined the investigation as and when called by the Investigating Officer.

This Court has heard arguments addressed on behalf of both the parties and has perused the material available on record. 8.

Considering the facts, circumstances and arguments advanced by all ld. Counsels, it is clear that minor child is now residing with his mother (complainant) and not with the applicant. Applicant is residing and working for gain in Delhi, as she is working as a nurse at the Institute of Liver and Biliary Sciences (ILBS), Vasant Kunj, New Delhi. She is also joining the investigation, as per ld. APP. Hence, there is no apprehension of applicant misusing the liberty of bail.

In view of the aforesaid and also considering the facts of this case, in the event of arrest, the applicant is directed to be released on bail on her furnishing personal bond in the sum of Rs. 50,000/- with one surety in the like amount, to the satisfaction of ld. Trial Court, subject to the following conditions:- i) The applicant shall not leave Delhi without prior permission of the concerned Trial Court.

ii) The applicant shall make herself available for interrogation/ questioning by the Investigating Officer as and when required and shall join the investigation whenever directed. iii) The applicant shall not directly or indirectly make an attempt to influence the witnesses or tamper with the evidence in any manner. iv).
