First Bail Application under Section 439 of the Code of Criminal Procedure, 1973 (Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023) has been filed on behalf of the Petitioner, Lalit ailas Laliy, for grant of Interim Bail for a period of 30 days in FIR No.717/2024 dated 18.11.2024 under Section 109(1) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, registered at Police Station Bharat Nagar, Delhi, on the medical grounds.

The Medical Status Report has been received from the Jail Authorities, which shows that the Petitioner is suffering from pleural effusion and has been constantly under treatment. He has been advised for pleural tapping from OPD from an outside hospital. 3.

Considering his medical condition as reflected from the medical documents, forwarded by the Jail Superintendent, it is evident that the Petitioner needs immediate medical treatment for which, he has to be taken The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. to an OPD at an outside Hospital.

Considering the totality of the circumstances, the Applicant/Petitioner is granted Interim bail for a period of three weeks from the date of his release, upon his furnishing a personal bond in the sum of Rs.50,000/- and one surety of the like amount, to be satisfaction of the learned trial court and further subject to the following conditions:- a) Applicant shall not leave Delhi/NCR without prior permission of the Court;

b) Applicant shall provide his mobile number and also the mobile number of his wife/surety to the IO concerned, both of which shall be kept in working condition at all times and he shall not change the mobile numbers without prior intimation to the Investigating Officer concerned;

c) Applicant shall inform the IO and the Jail Superintendent the address where he shall be available in Delhi. d) Applicant shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses. e) Applicant shall not stay near the complainant and shall not threaten the complainant and the other witnesses in any manner. f) Upon expiry of period of three weeks, as stated above, the Applicant shall surrender before the concerned Jail Superintendent. 5.

The application stands disposed of.
