By the present application, the applicant seeks interim bail for a period of ninety days in FIR No. 370/2019 dated 19.10.2019, registered at Police Station Burari, for offences under Sections 363/366/370 of the Indian Penal Code, 1860 and Sections 4/6 of the Protection of Children from Sexual Offences Act, 2012, on the ground that the ailing child of the applicant has to be taken care of.

The medical status report has been filed by the concerned Jail Superintendent. The relevant paragraphs are reproduced as under:
"The baby Aayansh is being reviewed by Paediatrician and Jail Doctor regularly. On 07/05/2025, the baby along with mother came in Dispensary with complaint of breath holding spell and abnormal body movement. The child was examined by on doctor duty and primary treatment was given. After the child was stable, he was referred in emergency to Deen Dayal Hospital for further management. The doctor advised treatment accordingly and called for follow up in OPD. The child was send to OPD to Deen Dayal Hospital, Pediatric department on 10/05/2025. The doctor admitted him for observation and proper treatment. The baby was examined and treated as a case of severe Anaemia. He was discharged on 13/05/2025 in stable condition with medications. He is under regular follow up by Jail visiting Paediatrician as well The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. as in Deen Dayal Hospital.
On 17/05/2025, he was referred to Deen Dayal Upadhyay Hospital, in Emergency Department for the complaint of fever, vomiting and cough. The Doctor examined him and advised treatment accordingly. The Baby returned back to Jail the same day. He was send to Deen Dayal Upadhyay Hospital, Pediatric Department for follow up on 22/05/2025. The Doctor reviewed the Baby and prescribed treatment accordingly. The Doctor stopped his syrup Iron for Anaemia due to vomiting. The Child received his routine vaccination on 13/06/2025 and examined by Paediatrician visited from Deen Dayal Upadhyay Hospital for the complaint of cold. The Baby is under regular follow up by Jail visiting Paediatrician from Deen Dayal Upadhyay Hospital. He was seen on 17/10/2025, 31/10/2025 by Paediatrician for the complaint of cold and cough. His Haemoglobin was checked for Anaemia on 07/11/2025 which is increasing gradually. The Child is stable and active. He is being provided diet from Jail.
At present, mother along with her baby boy are stable. This child is fully immunized according to his age. All are under follow-up and treatment of Jail visiting doctors and doctors posted in CJ-06 Dispensary and all prescribed medicines are provided to her from CJ-06 Dispensary."

From a perusal of the medical report, it is apparent that the child is being provided requisite treatment according to his ailments and that the child has also been taken care of well. A perusal of the medical report further reveals that at present, the child is stable and has been fully immunised according to his age. 4.
In view of the above, this Court does not consider it apposite to release the applicant on interim bail. 5.
The present application is accordingly dismissed. Pending application also stands disposed of.
