O R D E R

% 28.11.2025 I.A. 29697/2025 (Joint Application under Order XXIII Rule 3 of the CPC, 1908) 1.

The parties to the suit have jointly filed the present application under Order XXIII Rule 3 of the Civil Procedure Code, 1908 (CPC), for decree of the suit in terms of the Settlement Agreement dated 26.09.2025 (hereinafter "Agreement").

All the parties appear personally or through video conference, along with their counsels, and affirm the terms of the aforesaid Agreement. 3.

The provision under Order XXIII, Rule 3 of the CPC authorises the Court to pass a decree on a compromise wherein the parties to the dispute have made an arrangement to settle the dispute. stated in the provision that the settlement arrived at should meet the essentials laid down therein, namely, (i) the compromise is lawful (ii) it is reduced in writing (iii) it is duly signed by the parties arriving at the compromise.

The settlement has been agreed upon without fear or coercion and the parties appear to have entered into the Agreement on their own volition. 5.

The Court is satisfied that the settlement has been arrived at between the parties following due procedure and meeting the essentials specified under Order XXIII, Rule 3 of the CPC. Therefore, the parties shall be bound by the aforesaid settlement agreement.

In view of the aforesaid, the civil suit stands decreed in terms of the settlement agreement, and the parties shall be bound by the terms thereof. 7.

The Registry is directed to draw-up a decree sheet in terms of the Agreement, and the same shall form a part of the decree. CS(OS) 890/2024 and I.A. 44669/2024, I.A. 282/2025, I.A. 283/2025 In view of the order passed on I.A. 29697/2025, the civil suit, along with the pending applications stands disposed of.
