Petitioner has assailed orders dated 07.05.2025 and 29.08.2025 of the learned Commercial Court. However, learned counsel for petitioner submits on instructions that the petitioner shall confine this petition only to the order passed while dismissing the application under Order VII Rule 10 CPC vide order dated 29.08.2025.

As regards the dismissal of application under Order VII Rule 10 CPC, after addressing partly, learned counsel for petitioner on instructions seeks permission to withdraw this petition with liberty to raise before the trial court during final arguments, all grounds raised in the present petition. 3.

Accordingly, the petition and the accompanying applications are dismissed as withdrawn with liberty as sought.
