The present Letters Patent Appeal is directed against the judgment rendered by the learned Single Judge dated 18 October 2024. An issue appears to have been raised with respect to the assumption of jurisdiction by the Micro, Small and Medium Enterprises ["MSME"] Council seated at Mumbai. The appellant appears to have asserted that since the cause of action had not arisen therein, the Council had clearly erred in assuming jurisdiction. 4.

The learned Single Judge while examining the aforesaid contention has essentially rested its decision on the provisions made in Section 18(4) of the Micro, Small and Medium Enterprises Development Act, 2006 ["MSME Act"]. to the validity of that provision was raised or urged before the learned Single Judge. We consequently find no merit in the instant appeal. 5.
