% 14.03.2018 Respondent no.2-Nazi Aayesha is present in Court along with her counsel and has been identified by SI Santosh of police station New Usmanpur. She submits that she has settled the matter with the petitioner no.1 of her own free will and without any undue force, pressure or coercion. She further submits that petitioner no.1 had pronounced Talaq to her on 24th June, 2013 itself. She admits having received entire settled amount. She submits that she is not willing to pursue the FIR No. 459/2013 under Sections 498A/406/34 IPC and Section 4 of Dowry Prohibition Act, 1961 registered at police station New Usmanpur and the consequent proceedings against the petitioner no.1 and his relatives, that is, petitioner nos. 2 to 7 and
the same may be quashed.
Keeping in mind the settlement arrived at between the petitioner no.1 and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
