O R D E R

% 29.04.2019 I.A. 6103/2019 (application under Order 23 Rule 3 CPC for bringing on record terms of settlement )

1. The present suit has been filed for permanent injunction and restraining infringement, passing off, delivery up, damages etc.

2. Parties by way of this joint application state that they have settled their disputes and seek disposal of the present suit in view of the Settlement Agreement dated 16th April, 2019. The counsels support the Settlement Agreement and seek decree in terms thereof. The agreement is signed by the parties and duly supported by affidavits of their authorized signatories. The application also bears the signatures of the learned counsels of both the parties.

3. I have perused the terms of compromise/settlement mentioned in para- I to XIII of the settlement agreement arrived at between the parties and find the same to be lawful.

4. Accordingly, a decree is passed, in terms of the Settlement Agreement dated 16th April, 2019, which along with the Annexure thereto shall form part of the decree sheet. Parties shall remain bound by the terms of the settlement agreement.

5. Decree sheet be prepared.
