The affidavit of Mr.Vinod Kumar, Deputy Director, Veterinary Service Department, Civil Lines Zone, North Delhi Municipal Corporation has been perused.

In this affidavit it is stated that a public interest litigation (PIL) W.P.(C) No.1209/2006 relating to meat shops had been filed. An order was passed by the Division Bench on 03.9.2008 wherein it was held that only on the compliance of certain conditions licence be granted to the meat shop holders. The said writ petition was disposed of on 05.10.2010.

Respondents thereafter formulated a policy for grant of licences to meat shops. This was notified on 02.9.2011 and the revised policy is dated 13.01.2012. Subsequent thereto 28 meat shop holders who

which were carrying business at the aforenoted place i.e. on the main Road of Village Bharolla, Azadpur, Delhi had submitted their affidavits. Out of those 28 shops, 4 shops are lying sealed since 10.3.2015. None has approached the Department for de-sealing the same. The other persons had applied for licence. The Competent Authority examined their documents in terms of the aforenoted policies. Licence has now been granted to 18 persons. It is further stated that these meat shop holders are running their meat business from their respective shops. Learned counsel for the petitioner on this count submits that the meat sales are being run from the pavement. This is negatived by the clear submissions made by respondent no.2 in his affidavit coupled with various documents and photographs placed on record. The licensees of the 18 shops holders are carrying on business from shops which have closed door shutters and the sale is not being effected from the pavement. These photographs are a part of the record.

Subsequent affidavit of respondent no.2 i.e. of Mr.Praveen Kumar, Deputy Director, Veterinary Service Department, Civil Lines Zone, North Delhi Municipal Corporation also on the same lines is also a part of the record.

In view of the aforenoted facts which have emanated, nothing survives in this petition.

Petition disposed of.
